Welcome to EZ Stitch Digitizing. These Terms and Conditions govern your access to and use of our website, digital submission portals, and specialized design services. By placing an order, establishing an account, or interacting with our platform, you explicitly agree to be bound by the operational frameworks detailed below.
1. Nature of Service
EZ Stitch Digitizing operates an elite digital studio specializing in professional embroidery digitizing, file architecture optimization, and vector artwork conversion services.
All deliverable file formats are custom-crafted and rendered explicitly based on customer-supplied source graphics, physical measurements, and machine-specific format instructions.
These Terms form a legally binding service agreement between EZ Stitch Digitizing and the ordering entity or individual.
2. Order Processing & Digital Delivery Framework
Because our business model caters directly to the commercial production sector, our fulfillment operations observe strict digital delivery timelines:
Digital-Only Distribution: All completed design configurations are delivered exclusively via secure email or download portals. No physical goods, backing materials, or merchandise are shipped.
Fulfillment Windows: Standard orders typically observe a processing turnaround window of 12 to 24 business hours, dynamically scaling based on graphic complexity and current studio production volumes. Accelerated rush delivery tiers are available upon explicit confirmation.
Iterative Adjustments: Technical adjustments and modifications are included natively within your selected service tier, subject to the parameters outlined in Section 4.
3. Customer Specifications & Production Responsibilities
The precision of an embroidery sew-out or print vector is highly dependent on the quality of the initial configuration data. To guarantee technical accuracy, customers are required to supply:
Source Media: Clean, high-resolution original artwork files (acceptable formats include JPG, PNG, PDF, or native vector profiles).
Machine Extension Profile: Explicit declaration of the required embroidery machine format (e.g.,
.DST,.PES,.JEF,.EXP,.VP3).Dimensional Blueprint: Definitive, exact target size specifications for the final production run.
Substrate / Fabric Variable: The specific material type intended for decoration (e.g., unstructured caps, structured hats, performance t-shirts, heavy jackets, or high-pile towels).
Color Schemes: Preferred thread brand color arrays or specific hex choices (highly recommended for precision replication).
Important Liability Disclaimer: EZ Stitch Digitizing is categorically exempt from liability regarding production errors, delivery delays, machine damage, or substandard physical sew-out results stemming from low-resolution source files, missing details, or inaccurate configuration choices submitted by the customer.
4. Technical Revisions, Corrections, & Scope Restrictions
To maintain absolute production standards, every order is backed by comprehensive revision support:
Design Refinement: We provide unlimited technical edits and corrections until the file receives final production approval from your shop, provided the request remains strictly within the bounds of the original project brief.
Scope Changes & Redesigns: Requesting modifications based on newly submitted artwork layouts, modified size parameters that require structural re-digitizing, or completely altered instructions constitutes a change of project scope. These structural alterations are subject to supplemental redesign fees, which will always be communicated and approved before production restarts.
5. Secure Payment Infrastructure & Merchant of Record
Financial processing on our portal is engineered to observe elite security and encryption standards:
Processing Gateways: All financial checkouts, tokenized authorization fields, and gateway clearings are securely handled via Whop Payments (supporting primary credit/debit cards, digital wallet infrastructures, and cryptocurrency assets) and PayPal.
Merchant of Record Statement: When executing transactions via our standard web portals, Whop Inc. functions as our authorized Merchant of Record. Consequently, billing indicators on your corporate banking statements or credit cards will appear reflecting “WHOP” or “WHOP*EZSTITCH”.

6. Refund Integration
All cancellations, refunds, and technical dispute audits are regulated directly under our comprehensive Refund Policy, which is fully incorporated into these Terms by reference. In summary, custom digital files are fundamentally non-refundable once production completes and the client issues final approval. Refund reviews are strictly restricted to unresolvable file corruptions or complete deadline defaults, evaluated only after our unlimited revision workflow fails to fix the asset.
7. Intellectual Property & Usage Rights Guarantee
By transmitting design files, logos, sketches, or graphic layouts to our servers, you establish a definitive legal guarantee that you possess explicit ownership, current licensing, or valid authorization to digitize and reproduce the target graphics.
EZ Stitch Digitizing operates completely in good faith as a technical processing agent, transforming your supplied media into machine code.
You assume full, singular liability for copyright compliance, trademark tracking, and licensing status.
We reserve the unilateral right to deny processing for any order that appears to violate third-party intellectual property protections or trademark registration standards.
8. Structural Limitation of Liability
To the maximum extent permitted by applicable law, the cumulative liability of EZ Stitch Digitizing for any claims, errors, damages, or processing faults is strictly capped at the exact monetary amount paid by the customer for that specific service transaction. Under no circumstances shall we be held liable for:
Production bottlenecks or material losses caused by local embroidery machine calibration errors, improper thread tension, or operator error.
Structural thread breaks or substrate tearing encountered during physical production runs after a file has been approved.
Secondary commercial loss, delayed shipping expenses, lost business revenue, or consequential damages resulting from project processing delays.
Implementation faults caused by inaccurate or incomplete input parameters supplied by the client during order setup.
9. Dispute Mitigation & Automated Chargeback Actions
We prioritize clear communication and technical resolutions over legal escalations. If an output asset fails to match your production parameters, you agree to contact our technical team directly at info@ezstitchdigitizing.com before opening a payment dispute or filing a chargeback with Whop.com, card issuers, or PayPal.
We review all incoming support tickets within 24 to 48 hours to apply immediate, targeted corrections. Forcing a chargeback mechanism through a financial provider without enabling our support team to examine the log data violates this agreement, creates grounds for immediate storefront account suspension, and will be aggressively contested with formal order data logs, system logs, and delivery receipts.
10. Governing Law & Amicable Resolution
Any structural disputes, contractual conflicts, or operational claims originating from these Terms shall be handled first through mutual good-faith negotiation directly between our administrative panel and your organization before seeking formal external mediation or arbitration procedures.
